The following general terms and conditions apply to all contracts and services concluded between BleachMe GmbH, Bahnhofstrasse 8b, 6340 Baar (hereinafter referred to as “Seller”) and consumers or entrepreneurs (hereinafter referred to as “Buyer”).

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed. Entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity.

These general terms and conditions also apply to entrepreneurs without separate inclusion for all current and future contracts, deliveries and other services of the seller.

Conflicting terms or conditions of the entrepreneur that deviate from these general terms and conditions are hereby contradicted and are only deemed to have been agreed between the seller and the entrepreneur if the seller expressly agrees to their validity in writing.

2. Conclusion of contract, technical steps of the ordering process and correction of input errors

The essential features of the goods offered by the seller and the period of validity of limited offers can be found in the individual product descriptions on https://www.lipboom.ch.

 

2.1 Conclusion of contract

 

If the seller places products in his online shop on the website www.lipboom.ch, he makes a binding offer to conclude a purchase contract for this product. The buyer accepts the offer for the items contained in the shopping cart by clicking on the "Send order" button after completing the ordering process.

2.2 Technical steps of the ordering process

When ordering via the seller's online shop, the ordering process includes the following technical steps.

1.) First, the buyer selects the desired product by clicking on the "Add to cart" button.

2.) The products in the shopping cart are then displayed to the buyer. The products in the shopping cart can be deleted there by clicking the "Remove" button and the number can be increased or decreased.

3.) In order to complete the order, it is necessary for the buyer to confirm the seller's terms and conditions and to have taken note of the data protection regulations by ticking the boxes provided for this purpose.

4.) By clicking on the "Proceed to checkout" button, the buyer gets to the next step in the ordering process, "Invoice details". Here the buyer can enter his name, his address including billing address and, if applicable, a different delivery address as well as his e-mail address in the fields provided for this purpose. There is free standard shipping within Switzerland and paid shipping abroad.

5.) After the buyer has decided on a payment method offered by the seller, namely "credit card", "Paypal" * "Klarna" or "Twint" and has selected it accordingly, he completes the ordering process by clicking on the "Send order" button and accept the offer.

*When selecting the "Paypal" payment method, the buyer clicks on the "Order now" button to access the PayPal website and is automatically redirected to the order overview page of the seller's online shop after entering their login details and completing the payment process.

2.3 Correction of Input Errors

 

The buyer can correct his entries at any time up to the conclusion of the order or cancel the order process by closing the internet browser or clicking on the "back" button of the internet browser.

The contractual language is German, English and French.

4. right of withdrawal
   
   

The right of withdrawal only applies if the product is returned undamaged, unused and in its original packaging. The buyer takes care of the shipping. The return must be announced to info@lipboom.ch.

5. delivery terms

 

Orders are sent from Switzerland by post. The delivery period is usually 14 working days. The information is without guarantee. LIPBOOM® accepts no liability for any items damaged during delivery. Use and risk are transferred to the customer when the item is shipped.

5.1 Delivery abroad

If we make a delivery abroad, this will be done without charging Swiss VAT. All other applicable taxes and customs duties are the responsibility of the buyer. The refusal of acceptance does not release from the purchase and in the event of rejection, the entire invoice amount is due. Submissions are subject to a charge.

5.2 Delivery Time

 

We are only liable for compliance with the shipping and delivery times specified by us if we have expressly designated them as binding on the order confirmation. If a binding shipping or delivery date is exceeded, the customer is free to set a grace period or to withdraw from the contract immediately

6. Prices and payment options
   
   

The prices quoted by the seller are in CHF and include the statutory Swiss VAT and are final prices plus any additional shipping costs.

6.1 Payment Options

The following payment options are available to the buyer in the seller's online shop:

1.) Klarna (invoice)

In cooperation with Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden, we offer the “Invoice” payment option. Payment is made to Klarna in each case.

The payment period is 30 days (Switzerland) or 14 days (Germany, Austria) from dispatch of the goods/ticket/or, in the case of other services, the provision of the service. The use of the invoice payment method requires a positive credit check. In this respect, we forward your data to Klarna for the purpose of address and creditworthiness checks as part of the purchase initiation and processing of the purchase contract. Your personal information will be treated by Klarna in accordance with the applicable data protection regulations and in accordance with the information in Klarna's data protection regulations.

2.) PayPal

If the buyer chooses the PayPal payment method, the buyer pays the purchase price via the payment service provider PayPal (Europe) S.à rl et SCA, 22-24 Boulevard Royal, L-2449 Luxembourg. If the buyer already has a PayPal account with PayPal, the buyer will be forwarded to PayPal and must confirm the payment order to the seller after entering his access data for the buyer's PayPal account. If the buyer does not have a PayPal account, the payment can be made after forwarding to PayPal using the "Payments without a PayPal account" function. 3.) Credit card

If the buyer chooses the credit card payment method, the purchase price will be reserved on your credit card at the time of the order ("authorization"). The buyer's credit card account is actually debited at the time the seller ships the goods to the buyer.

4.) Twint

If the buyer chooses the Twint payment method, he will be informed of the Twint account in the order confirmation. The goods will be delivered to the buyer after receipt of payment.

1.) LIPBOOM® can grant vouchers (e.g. welcome vouchers) or gift cards (purchased voucher cards). Vouchers and gift cards are personal and non-transferable. Vouchers and gift cards can only be used for future purchases in the lipboom.ch online shop. They cannot be offset against shipping costs. The redemption of a voucher or a gift card can be tied to a minimum order value. LIPBOOM® reserves the right to only accept one voucher or one gift card per order and not to allow the combination of voucher and gift card. The voucher or gift card cannot be exchanged for money, paid out or returned. The respective credit does not earn interest. The vouchers are valid for 1 year after issue.

2.) Application

On the shopping cart page, enter the voucher code in the “Voucher code” field provided. The corresponding amount will be deducted directly from the current order.

10. retention of title
    
    

The goods remain the property of the seller until full payment has been made.

11. Liability
    
    

The seller excludes liability for slightly negligent breaches of duty, provided these do not relate to damage to life, limb or health or guarantees or claims due to malicious misconduct or under the Product Liability Act are relevant. Furthermore, liability for the breach of obligations, the fulfillment of which is essential for the proper execution of the contract and on the observance of which the buyer may regularly rely, remains unaffected. The same applies to breaches of duty by the seller's legal representatives or vicarious agents.

12. warranty

If there is a defect in the purchased item that we have recognized, we are entitled, at our own discretion, either to remedy the defect or to deliver a replacement. Further claims by the buyer are excluded, regardless of the legal grounds.

13. Refund warranty
    
    

You have 14 days after taking possession of the goods to cancel your order if the goods are closed.

Please note that we cannot cover the costs of the return. We ask you to pack the products securely so that they cannot be damaged during shipping.

14. place of jurisdiction
    
    

The place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship is Zurich, Switzerland for both parties.

15. Influencer program
    
    

The cooperating influencer has a non-competition clause during the cooperation and 12 months after the execution of the assignment. In the event of non-compliance, the influencer undertakes to refund the agreed amount.

16. Final Provisions
    
    

Should a provision of these General Terms and Conditions be ineffective, the rest of the contract shall remain effective. The relevant statutory provisions shall apply in place of the ineffective provision.
